Terms & Conditions
These Terms explain how Numerical Archive may be used, how digital products are licensed and delivered, and what customers should understand before purchasing an engineering resource or requesting a custom simulation.
By accessing Numerical Archive, purchasing a product, creating an account or submitting a request for services, you agree to these Terms. If you do not agree, do not use the affected service or complete the purchase.
Acceptance of these Terms
These Terms and Conditions govern your access to and use of the Numerical Archive website, digital products, downloadable files, tutorials, communications and custom engineering services. They form an agreement between you and the operator of Numerical Archive.
Additional terms may apply to a specific quotation, custom project, subscription, payment provider or licensed third-party service. Where additional written terms conflict with these Terms, the more specific written terms will apply to that transaction.
Scope and definitions
In these Terms:
- “Website” means the Numerical Archive website and its related pages.
- “Digital Product” means any downloadable model, tutorial, report, data file, script, document, archive or related resource.
- “Custom Service” means simulation, review, consulting, coding, research support or other work performed under an agreed scope.
- “Customer” or “you” means the person or organisation using the Website, purchasing a Digital Product or requesting a Custom Service.
Eligibility, account information and authority
You must have legal capacity to enter into a contract. If you use the Website or place an order on behalf of a university, company or other organisation, you confirm that you are authorised to act for that organisation.
Information supplied during registration, checkout or communication must be accurate, current and complete. You are responsible for protecting account credentials and for activity performed through your account.
Product descriptions and compatibility
We aim to describe each Digital Product clearly, including its engineering subject, software information, listed files, validation status and whether instructional video content is included. Images and previews are illustrative and may not show every file, setting or result contained in a package.
Before purchasing, you are responsible for reviewing the full product page and confirming that the resource is appropriate for your purpose, software environment, operating system, technical experience and required output.
Where a tutorial video is included, it will be identified on the product page. Product prices may vary according to the scope, validation work, documentation and instructional content included.
Orders, pricing and payment
Prices and available payment methods are displayed at checkout or confirmed in a written quotation. Payment methods may include PayPal, card payment or another method made available for the transaction. Cryptocurrency payment is available only where expressly confirmed in writing, together with the relevant wallet and payment instructions.
Third-party payment providers process payments under their own agreements and privacy practices. We do not control a payment provider’s approval, security review, currency conversion, fees, account limitation or dispute process.
An order is accepted when payment is successfully confirmed and access or delivery is authorised. We may reject or cancel an order where payment cannot be verified, the price is clearly erroneous, the transaction appears unlawful or fraudulent, or delivery would violate an applicable restriction.
Digital delivery and download access
Digital Products are normally delivered electronically after payment confirmation, by account access, download page, secure link or email. Delivery timing may be affected by payment review, email filtering, account verification, maintenance or technical interruption.
Download links may have a time limit, download limit or account requirement. You should download and securely back up purchased files within the stated access period. Sharing a private download link or attempting to bypass delivery controls is prohibited.
If a paid file is missing, corrupted, inaccessible or materially different from the listed package, contact us promptly with the order information. We will use reasonable efforts to verify the issue and restore access, replace the affected file or provide an appropriate remedy.
Refunds and cancellations
Because Digital Products can be accessed, copied or downloaded immediately, purchases are generally final once digital delivery or download access has begun. Please review the description, compatibility information, included files and tutorial status before ordering.
This policy does not exclude rights or remedies that cannot legally be waived. Where applicable law provides a mandatory cancellation, conformity or refund right, that law will apply. We may also provide a remedy where a verified duplicate payment occurred or where the purchased files cannot be delivered, are corrupted, or materially fail to match the published description.
A change of mind, lack of required software, insufficient technical experience, failure to review the product description or incompatibility that was disclosed before purchase will not normally qualify for a refund.
Licence and permitted use
Unless a product page or written agreement states otherwise, purchasing a Digital Product grants the named customer a limited, non-exclusive, non-transferable and revocable licence to use the files for personal learning, internal research or the customer’s own professional analysis.
You may modify the working files for your own permitted project or research. You may not:
- resell, sublicense, redistribute, publish or upload the Digital Product or a substantial part of it;
- share files, private links or account access with another person or organisation;
- present the original model, tutorial, documentation or package as your own product;
- use the Digital Product to create a competing library, resale package or unauthorised training product;
- remove copyright, attribution, ownership or security notices.
A university, laboratory, company or team requiring multi-user access must obtain a separate written licence where applicable.
Customer responsibilities
You are responsible for:
- reviewing assumptions, dimensions, units, material properties, interactions, loads and boundary conditions;
- checking software-version compatibility and maintaining valid third-party software licences;
- verifying the model and results for the intended application;
- complying with engineering standards, academic rules, export restrictions and applicable law;
- maintaining backups of downloaded and modified files;
- obtaining any approval required before using results in design, construction, safety-critical work or publication.
Custom simulation and engineering services
A Custom Service begins only after the technical scope, deliverables, schedule, price, payment milestones and required customer inputs have been agreed in writing. A submitted contact form or initial discussion does not itself create an obligation to accept a project.
The customer must provide accurate and lawful information, reference material and technical requirements. Changes to the agreed scope, incomplete information or delayed feedback may affect price and schedule. Ownership and permitted use of custom deliverables will be stated in the relevant quotation or service agreement.
Third-party software, services and links
Digital Products may be designed for use with third-party software such as ABAQUS or other engineering platforms. Unless explicitly stated, the purchase does not include that software, a software licence, updates or technical support from the software developer.
References and links to third-party services are provided for convenience. Their availability, content, security and terms are controlled by the relevant third party.
Educational and engineering-use disclaimer
Numerical simulation involves assumptions, approximations and modelling choices. Our Digital Products are provided as engineering, research and educational resources. They are not a substitute for project-specific investigation, independent verification, professional engineering judgement or approval by a qualified person.
You must not rely on a resource as the sole basis for a safety-critical decision, final design, construction instruction, certification or regulatory submission without appropriate review.
Intellectual property
The Website, branding, text, graphics, tutorials, numerical models, scripts, documentation, product organisation and other original materials are owned by or licensed to Numerical Archive and are protected by applicable intellectual-property laws.
No ownership right is transferred by access, purchase or download. Rights not expressly granted under these Terms are reserved.
Prohibited conduct
You must not:
- use the Website or products for unlawful, fraudulent, deceptive or infringing activity;
- attempt to gain unauthorised access to accounts, private files, servers or security controls;
- introduce malware, automated scraping, excessive requests or other harmful code or traffic;
- misrepresent your identity, authority, academic authorship or ownership of a resource;
- use our material in a way that violates the rights, confidentiality or safety of another person.
Availability, corrections and changes
We may update, correct, replace, suspend or discontinue Website content, products, prices, features or services. We may also correct typographical, technical or pricing errors.
We do not guarantee uninterrupted availability. Planned maintenance, hosting failure, cybersecurity events, payment-provider interruption or circumstances outside our reasonable control may temporarily affect access.
Warranties and representations
We aim to provide accurate descriptions and functional files. Except for obligations that cannot be excluded by applicable law, the Website and Digital Products are provided on an “as available” basis without a guarantee that they will satisfy every research, educational or professional objective.
We do not guarantee that every file is error-free, compatible with every software version, or suitable for a purpose that was not expressly agreed in writing.
Limitation of liability
To the maximum extent permitted by applicable law, Numerical Archive will not be liable for indirect, incidental, special, punitive or consequential loss, including loss of profit, opportunity, data, research time, business, reputation or anticipated savings arising from use of—or inability to use—the Website, a Digital Product or a Custom Service.
To the maximum extent permitted by law, our aggregate liability relating to a specific Digital Product will not exceed the amount paid for that product. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
Privacy and communications
Information submitted through the Website is used to process orders, provide access, respond to requests, prevent misuse and administer services. Additional details will be provided in the Numerical Archive Privacy Policy.
By providing contact information, you agree to receive transactional messages concerning orders, downloads, technical requests, security and service administration. Marketing communications, where offered, will be managed separately.
Suspension and termination
We may restrict access, suspend an account, invalidate a private download link or terminate a licence where we reasonably believe these Terms have been breached, payment has been reversed, access is being shared, or use creates a legal, security or intellectual-property risk.
Provisions concerning payment, licensing, intellectual property, disclaimers and liability continue to apply after access ends where their nature requires it.
Applicable law and dispute resolution
These Terms are interpreted under the law applicable to the operator and the transaction, without limiting mandatory consumer rights that cannot be waived under the law of the customer’s country of residence.
Before starting formal proceedings, the parties should attempt to resolve a dispute through good-faith written communication. If resolution is not possible, the dispute may be submitted to the courts or dispute-resolution body having jurisdiction under applicable law.
Questions and legal notices
Questions about these Terms, a purchase or a Digital Product may be submitted through the Contact page or by email. Please include the relevant order number where available.
We may revise these Terms to reflect changes in products, services, payment methods, law or operating practices. The updated version will be published on this page with a revised effective date. Changes do not retroactively alter a completed transaction unless required by law or agreed in writing.
